This privacy policy applies to information collected through the applications built by Luke Zhao (“Apps,”“we,”“us,”“our”), which include “Noto” and “Ink” by August of 2020, and/or any related services, sales, marking or events. Please read this privacy notice carefully as it will help you make informed decisions about trusting some of your personal information with us.

In this policy notice, we seek to explain to you in the clearest way possible what information the Apps collect, how it is used, and what rights you have in relation to it.

Information we collect

Information automatically collected: Some information, such as your IP address and/or device characteristics, is collected automatically when you visit, use, or navigate the Apps. This information does not reveal your specific identity (for example, your name or contact information) but may include device and usage information, such as your IP address, device characteristics, operating system, version information, language preferences, referring URLs, device name, country, location, and other information about how and when you use our Apps and other technical information. This information is primarily needed to maintain the security and operation of the Apps, and for data analytics and reporting purposes.

Information collected with consent: Device access may be requested when you use the Apps, including your device’s camera, microphone, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Information we do not collect: Any personal content created by users in the Apps is not stored or collected in any way. The notes you create are stored in your own devices, as well as Apple’s iCloud Drive if you opt to do so.

How we use your information

Personal information collected via the Apps may be processed for legitimate business purposes, for security and operation purposes, and/or for compliance with the legal obligations.

Your information may be used to request feedback and to contact you about your use of our Apps, to help fulfill a contract with users if they consent so, to identify usage trends, to determine the effectiveness of a promotional campaign to evaluate the products, marketing and your experience of the Apps, or to fulfill other legitimate purposes. Users should note here the specific processing grounds being listed above are only illustrative instead of exhaustive examples with regards to the purposes laid out in the preceding paragraph.

How and why we share your information

Your information would only be shared with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

Data collected from users may be shared based on the following legal basis:

• Consent: Your data may be shared if you have given the Apps specific consent to use your personal information in a specific purpose.
• Legitimate Interests: You data may be shared when it is reasonably necessary to achieve the Apps’ legitimate business interests.
• Performance of a Contract: your personal information may be shared when the Apps have entered into a contract with you so that the terms of the contract may be fulfilled.
• Legal Obligations: Your information may be disclosed where the Apps are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
• Vital Interests: Your information may be disclosed where it is deemed necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which the Apps and other related parties are involved.
• External Supporting Services Capacitation: Your data may be shared with third party vendors, service providers, contractors or agents who perform services for the Apps or on our behalf and require access to such information to do that work. Examples include: payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts.  Selected third parties may be allowed to use tracking technology on the Apps, which will enable them to collect data about how you interact with the Apps over time. This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Unless described otherwise, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.
• Business Transfers. Information collected via the Apps may be transferred in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
• Third-Party Advertisers. Third-party advertising companies may be used to serve ads when you visit the Apps. These companies may use information about your visits to the Apps, our websites or other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.

We update this policy as necessary to stay compliance with relevant laws. The updated version will be indicated by an updated revision date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
